ExxonMobil Faces Clean Air Act Lawsuit For Violations At Nation's Largest Refinery

Sierra Club and Environment Texas announced today that they intend to sue ExxonMobil Corporation in federal court for thousands of violations of the federal Clean Air Act at its Baytown refinery and chemical plant complex.  The suit would be the third case filed by the two environmental groups since 2008 to stop illegal air emissions arising from so-called “upset” events at facilities along the Houston Ship Channel.

Environment Texas and Sierra Club File Second Lawsuit to Stop Illegal Air Emissions in Harris County

HOUSTON - Sierra Club and Environment Texas filed a lawsuit today in federal district court against Chevron Phillips Chemical Company LP. The suit, coming on the heels of the groups' landmark settlement with Shell Oil Company in June targeting illegal air emissions arising from so-called "upset" events, claims that Chevron Phillips has repeatedly violated the Clean Air Act at its Cedar Bayou chemical plant in Baytown, Texas. The suit alleges the company released more than a million of pounds of excess air pollutants since 2003, including toxic chemicals such as benzene and 1,3-butadiene.

Sierra Club and Environment Texas announced today that they have filed a proposed Consent Decree in federal court that would settle their Clean Air Act lawsuit against Shell Oil Company and two affiliates. If approved by U.S. District Judge David Hittner, the settlement would require dramatic air pollution reductions at Shell's Deer Park, Texas, refinery and chemical plant, extensive plant upgrades, enhanced monitoring of air emissions, and a record penalty for a citizen enforcement suit.

New Report Links Toxic Pollution with Health Hazards as EPA Acts to Restrict Pollution Data

Exposure to dangerous toxic pollution from industrial facilities threatens communities in Texas and across the country, according to a new report released today by Environment Texas. A coalition of groups called on the Texas legislature and congress to take steps to protect the public’s right to know and to reduce emissions.

The report, Toxic Pollution and Health, uses information from the federal Toxic Release Inventory (TRI) to analyze toxic pollution linked to serious health problems such as cancer, birth defects or neurological damage. Due to a recent EPA action restricting the public’s right-to-know, today’s report may provide one of the last complete pictures of toxic pollution in Texas.
